ChapterIGeneralProvisions
Article1ThepresentLawisformulatedaccordingtotheConstitutionforthepurposeofregulatingtheadministrationofcivilservants,ensuringthelegitimaterightsandinterestsofcivilservants,strengtheningthesupervisionofcivilservants,formahigh-qualitytroopofcivilservantssoastopromoteadiligentandhonestgovernmentandenhancetheworkingefficiency.
Article2Theterm"civilservants"asmentionedinthepresentLawreferstothosepersonnelwhoperformpublicdutiesaccordingtolawandhavebeenincludedintothestateadministrativestaffingandwhosewagesandwelfarearebornebythestatepublicfinance.
Article3Theobligations,rightsandadministrationofcivilservantsshallbegovernedbythe
presentLaw.
Wheretherearedifferentprovisionsontheappointment,dismissalandsupervisionofleadingmembersofcivilservantsandontheobligations,rightsandadministrationofjudgesandprosecutingattorneys,suchprovisionsshallbeobserved.
Article4TheguidanceofMarxism,Leninism,MaoZedongThoughtandDengXiaopingTheoryandtheimportantthoughtof"ThreeRepresents"shallbepersistedinthecivilservantsystem.ThebasicrouteofthepreliminarystageofsocialismandthecadreroutesaswellastheguidelinesoftheChineseCommunistParty(CPCshallbecarriedoutinthecivilservantsystem.TheprinciplethattheCPCassumestheadministrationofcadresshallbeinsisted.
Article5Theprincipleofopenness,equality,competitionandselectingthesuperioronesshallbeheldintheadministrationofcivilservants,whichshallbecarryoutaccordingtothelegalpowerlimits,qualifications,standardsandprocedures.
Article6Theprincipleofpayingequalattentiontosupervisoryrestrictionandincentiveguarantyshallbeheldintheadministrationofcivilservants.
Article7Theprincipleofmakingappointmentonmeritandhavingbothpoliticalintegrityandprofessionalcompetenceshallbeheldintheappointmentofcivilservantswhereimportanceshallbeattachedtopracticalachievementsofwork.
Article8Thestateadoptsaclassifiedadministrationoncivilservantssoastoenhancetheadministrativeefficiencyandlevelofscientificadministration.
Article9Anyactofacivilservanttoperformhisdutyaccordingtolawshallbeprotectedbylaw.
Article10Thecentraladministrativedepartmentofcivilservantsshalltakechargeofthecomprehensiveadministrationofcivilservants.Thelocaladministrativedepartmentsofcivilservantsabovethecountylevelshalltakechargeofthecomprehensiveadministrationofcivilservantswithinthejurisdictionaldivisionsthereof.Theadministrativedepartmentofcivilservantsatahigherlevelshallguidetheadministrationofcivilservantsascarriedoutbyitscounterpartatalowerlevel.Theadministrativedepartmentofcivilservantsatalllevelsshallguidetheadministrationofcivilservantsofallorgansatthesamelevel.
ChapterIIQualifications,ObligationsandRightsofACivilServant
Article11Acivilservantshallmeetthefollowingrequirements:(1Havingthenationalityofthepeople'sRepublicofChina;(2Reachingthefullageof18;
(3UpholdingtheConstitutionofthepeople'sRepublicofChina;(4Havinggoodethics;
(5Beinginaproperhealthstatetoperformhisfunctionsanddutiesnormally;(6Havingtheeducationallevelandworkingcapacityasrequiredbythepost;and
(7Anyotherrequirementasprescribedbylaw.
Article12Acivilservantshallperformthefollowingobligations:
(1PlayinganexemplaryroleinobservingtheConstitutionandthelaw;
(2Earnestlyperforminghisfunctionsanddutiesaccordingtotheprescribedpowerlimitandprocedureandmakingeffortstoenhancehisworkingefficiency;
(3Servingthepeopleheartandsoulandbeingsubjecttothesupervisionofthepeople;(4Safeguardingthesecurity,honorandinterestsofthestate;
(5Beingloyaltohisduty,beingdiligentandpious,obeyingandcarryingintoeffectthedecisionsandordersmadebythesuperiororgan;
(6Keepingthesecretsofthestateandthesecretsrelatingtohiswork;
(7Complyingwiththedisciplines,scrupulouslyabidingbytheprofessionalethics,andplayinganexemplaryroleinobservingthesocialmorals;(8Beinghonestandclean,justandupright;(9Anyotherobligationsasprescribedbylaw.
