Shan ghai Property Lease Con tract 特别告知
IMPORTANT 一、 本合同适用于本市行政区域范围内的商品房预租以及按市场化原则协商确定租赁的房屋租赁,不包括按市政府
规定的租金标准出租的公有居住房屋、行政调配方式出租和政府投资建造的公益性的非居住房屋以及在〈〈条例》施行前
按照市政府规定的租金标准出租的私有居住房屋的租赁。
This Contract is applicable to pre-lease of commodity houses and market-based house lease within the administrati ve
area of Shanghai Municipality, excluding lease of public residential properties based on the government-specified re ntal rates,
lease of houses in the manner of administrative allocation, lease of non-residential public properties whose c onstruction is
funded by the government, and the lease of private residential properties leased at the government-specifi ed rental rates
before implementation of Shanghai Regulations on Leasing of Housing Premises. 二、 预租仅限于房地产开发企业投资建造,并已取得预售许可证的商品房,但房地产开发企业已经预售的商品房不
得预租;商品房预购人也不得将预购房商品房预租。
Pre-lease is only limited to the commodity houses built and invested in by real estate developers and issued with the pre-sale permit, excluding the commodity houses already pre-sold by real estate developers. The pre-buyers of co
mmodity houses shall not pre-lease the pre-bought properties.
三、 本合同条款中的【出租】或【预租】为提示性符号,表示该条款适用于出租行为或预租行为。本合同作为房屋
租赁合同使用时,只能采用标有【出租】部分的内容;而作为商品房预租合同使用时,则只能采用【预租】部分的条款
和补充条款中的“预租有关事宜”部分的条款。其他未标有【】符号的条款作为通用性条款,不论预租或出租都适用。
The mark leasel orpre-leasd indicated in the provisions of this Contract is indicative, which means that the marked clause is applicable to lease or pre-lease activity, as the case may be. If this Contract is used for lease, only the provisions marked with lease can be adopted, while only the provisions marked with pre-leasd and the sup plementary clauses concerning pre-lease matters are applicable to the pre-lease case. Other provisions without the “ l ” mark are for general purpose, applicable to both lease and pre-lease. 四、 本合同用于商品房预租的,在该商品房竣工,房地产开发企业办理了房地产初始登记、取得了房地产权证后,
预租双方当事人应当签订商品房使用交接书。该合同即转为房屋租赁合同,合同内的原预租条款履行完毕。
If this Contract is used for pre-lease of commodity houses, the parties to the pre-lease shall enter into a commod ity house
occupancy takeover agreement after the commodity house is completed and its developer completes the real estate initial
registration and obtains the certificate of title thereto. Thereafter, this contract will be converted into a lea se contract and all the
pre-lease provisions contained herein are fulfilled. 五、 本合同文本系市房地资源局和上海市工商管理局根据〈〈上海市房屋租赁条例 》制定的范本(试行)。其合同
条款均为提示性条款,供租赁双方当事人约定采用。本合同中的未尽事宜可由甲、乙双方协商一致后,订立补充条款予
以明确。
This contract is a sample form (for trial developed by Shanghai Municipal Housing, Land and Resource Adminis tration Bureau and Shanghai Administration of Industry and Commerce in accordancewith Shanghai Regulations on Le asing of Housing Premises. All its provisions are informative for the parties to lease or pre-lease. Anything not covere d hereunder may be negotiated and agreed upon between the Parties in the form of supplementary clauses. 六、 本合同签订前出租人应向承租人出具房地产权证或其他权属证明,房地产开发企业向预租人出具预售许可证。
并相互交验有关身份证明。其中将房屋出租给外来流动人员的,出租人还应出示公安部门发放的〈〈房屋租赁治安许可证》。

Before exec ution of this Contract, the lessor shall present to the lessee the certificate of title to the leased p remises or other documents supporting his/her ownership. The real estate developer shall present the pre-sale permit to the pre-lessor.
The lessor and the lessee shall examine the ID certificate of each other. Where the house is leased to any non-Shanghai
resident in transit, the lessor shall present the Security Permit for House Lease issued by public se curity authorities. 七、 本合同签订后的15日内当事人应按规定办理合同登记备案。其中,属房屋租赁的,应向房屋所在地的房地产
交易中心或农场系统受理处办理,领取租赁合同登记备案证明;属于商品房预租的,外销商品房应向市房地产交易中心
办理登记备案;内销商品房向房屋所在地的房地产交易中心办理登记备案。预租商品房竣工取得房地产权证,由双方当
事人订立预租商品房使用交接书后,再按规定向房屋所在地的房地产交易中心或农场系统受理处办理登记备案,领取租
赁合同登记备案证明。租赁合同经登记备案后,当发生重复预租、出租、租赁期间房屋转让或设定抵押后被处分等事实 时,可以对抗第三人。
The parties to this Contract shall complete contract registration procedures as required within 15 days upon contra ct
signing thereof. In the case of lease, the parties shall register with the real estate trade center or the farm system f iling office at
the place of the leased premises and then obtain the certificate of lease contract registration. In the case of pre-lease of commodity houses, those for overseas sale shall be registered with the Municipal Real Estate Trade C enter while those for domestic sale shall be registered with the local real estate trade center at the place of the leased
premises. After the pre-leased commodity house is completed and issued the certificate of title and the parties enter i nto the
pre-leased commodity house occupancy takeover agreement, the parties shall register again with the real estate trade center
or the farm system filing office at the place of the leased premises and obtain the certificate of lease con tract registration. The
registration of the lease contract can provide defense against any third party in the case of repea ted pre-lease or lease or
assignment of house during the term of lease or disposal of the house due to mortgage durin g the term of lease. 八、 当事人一方要求登记备案,而另一方不予配合的,要求登记备案的一方可持本合同、有效身份证明等有关文 件办理登记备案。
If a party requests registration of this contract but the other party refuses to cooperate, the party requesting such
registration may alone register the contract by presenting this contract, valid ID certificate and other relevant document s.
九、 屋租赁保证金是一种履约保证的措施。房屋出租时,出租人可以与承租人在合同中约定收取房屋租赁保证金。
租赁保证金的数额由租赁双方当事人约定。租赁关系终止时,房屋租赁保证金除用以抵充合同约定由承租人承担的费用 外,剩余部分应当归还承租人。
十、本合同文本可向市或房屋所在地区、县房地产交易中心或农场系统受理处购取。双方当事人使用本合同前仔细
阅读,认真了解各条款内容。
This contract form is available at Shanghai Municipal Estate Trade Center or farm system filing office or local e state trade
enter or farm system filing office in the district or county where the leased premises are located. The parti es shall carefully
read this contract before use. 十一、本合同为示范文本,供当事人参照使用

If the lease arrangement under this contract is brokered by an agency, the agency or the broker shall be required to sign

平等自愿公平和诚实信用的基础上,经协商一致,就乙方承租甲方可依法出租 (出租/预租的房屋事宜,订立本合同。
This Contract is made by and between the Parties on the leasing of the house owned by the Lessor and legally l easable (leasable/pre-leasableto the Lessee in accordance with the Contract Law of the Peoples Republic of China a nd Shanghai Regulations on Leasing of Housing Premises ( Regulations undr the principles of equality, free will an d good faith. 一、出租或预租房屋情况
Particulars of Leased Premises 1- 1甲方出租(出租/预租)给乙方的房屋座落在本市xxx /县)xx^ xxx /新村)xxx /幢)XX (部位)
XX(以下简称该房屋)。该房屋出租实测建筑面积为xxx平方米,房屋用途为住宅,房屋类型为花园住宅、结构为钢混。
该房屋的平面图见本合同附件(一)。

1-3该房屋的公用或合用部位的使用范围、条件和要求;现有装修、附属设施的内容标准及需约定的有关事宜,
由甲、乙双方分别在本合同附件(二)、(三)中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合
同终止时乙方向甲方返还该房屋的验收依据。
The scope of use, conditions and requirements in respect to the public or common areas of the Leased Premises, the
particulars and standards of existing decorations and auxiliary facilities and other agreements between the Parties are provided
in Annex 2 and Annex 3 hereto, respectively. The Parties agree that these annexes shall be considered th e basis for
acceptanceof the Leased Premises as the Lessor delivers the Leased Property to the Lessee and when the Lessee returns the
same to the Lessor upon expiration hereof.
、租赁用途
Purpose 2- 1乙方向甲方承诺,租赁该房屋作为住宅使用,并遵守国家和本市有关房屋使用和物业管理的规定。
The Lessee hereby undertakes to the Lessor that the Lessee shall use the Leased Premises exclusively for resident ial purpose and abide by regulations of Shanghai and China governing the use of housing premises and property mana gement. 2- 2乙方保证,在租赁期内未征得甲方书面同意以及按规定须经有关部门审批而未核准前,不擅自改变上述约定 的使用用途。
The Lessee undertakes that, during the Term of this Contract, the Lessee shall not change the purpose specified a bove
without written consent of the Lessor or, if applicable, approval by relevant authorities. 三、交付日期和租赁期限
Date of Delivery and Term of Lease 3- 1甲乙双方约定,甲方于 "心年>月"当日或之前向乙方交付该房屋。房屋租赁期自
xxxx x XX日起至xxxx

The Parties agree that the Lessor shall deliver the Leased Premises to the Lessee before xxx The term of lease shall be from xxx to xxx
3- 2租赁期满,甲方有权收回该房屋,乙方应如期返还。乙方需继续承租该房屋的,则应于租赁期届满前二个月,
向甲方提出续租书面要求,并且双方重新商定租赁合同。
The Lessor shall have the right to take back and the Lessee shall return the Leased Premises upon expiration of the
Term. If the Lessee wishes to continue to lease the Leased Premises, a written request for extension shall be give n by the
Lessee to the Lessor two months prior to expiration hereof and then, upon consent of the Lessor, this Contr act may be
renewed on mutually acceptable terms.

四、租金支付方式和期限
Payment Mode and Term of Rental
4- 1甲、乙双方约定,月租金总计为(人民币) x元。(大写:整)
The Parties agree that the monthly rental shall be RMB xxx
4- 2乙方应于每月1日前向甲方支付租金。逾期支付的,每逾期一日,则乙方需按日租金的千分之三支付违约金。
The Lessee shall pay the rental to the Lessor before the first day of each month, or else shall pay the Lessor a
penalty equal to 0.3% of the daily rental for each day of delay. 4- 3乙方支付租金的方式如下:见补充条款第一条
Mode of rental payment by the Lessee: See Article 1 of Supplementary Clauses. 五、保证金和其他费用
Security Deposit; Other Costs and Expenses 5- 1甲乙双方约定,甲方交付该房屋时,乙方应向甲方支付房屋租赁保证金,保证金为贰个月的租金,即(人民币)
xxx元。
The Parties agree that the Lessee shall, upon delivery of the Leased Premises by the Lessor, deposit with the Le ssor the rental for two months totaling RMB xxx
甲方收取保证金后向乙方开具收款凭证。
The Lessor shall issue a receipt to the Lessee after receiving the Security Deposit. 租赁关系终止时,甲方收取的房屋租赁保证金除用以抵充合同约定由乙方承担的费用外,剩余部分无息归还乙方。
Upon expiration of the lease, the Security Deposit received by the Lessor shall be returned without interest to the Lessee
after deduction of the costs and expenses payable by the Lessee as agreed upon by the Parties.
5- 2租赁期间,使用该房屋所发生的水、电、煤、通讯设备、宽带费用等费用由乙方承担。其他有关费用如物业管 理等均由甲方承担。
During the term of lease, all the costs and expensesof water, electricity, gas, communication devices, broadband and in
the Leased Premises shall be for the account of the Lessee. Other costs and expenses,including property mana gement fees,
shall be paid by the Lessor. 5- 3 (甲方/乙方负责支付的上述费用,计算或分摊办法、支付方式和时间:见补充条款第十一条
For calculation, sharing and payment mode and time of the foregoing amounts payable by (the Lessor/Lesseesee Article
11 of Supplementary Clauses. 六、房屋使用要求和维修责任
Use and Maintenance of the Leased Premises 6- 1租赁期间,乙方发现该房屋及其附属设施有损坏或故障时,应及时通知甲方并提供甲方以方便进行检修;甲方
应在接到乙方通知后的三日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。
If the Lessee finds any damage or anomaly on the Leased Premises and/or auxiliary facilities thereof during the Term, the Lessee shall promptly notify the Lessor on the necessary repair and restoration. The Lessor shall repair and restore within three days upon receiving such notice from the Lessee. Where the Lessor fails to make such repair or restoration within the specified time limit, the Lessee may do the same at the reasonable cost of the Lessor. 6- 2租赁期间,乙方应合理使用并爱护该房屋及其附属设施。因乙方使用不当或不合理使用,致使该房屋及其副属
设施损坏或发生故障的,甲方代为维修,费用由乙方承担。甲方将提供修膳费用之收据。
The Lessee shall reasonably use and protect the Leased Premises and auxiliary facilities thereof during the Term. Any
damage or anomaly to the Leased Premises and/or any auxiliary facilities thereof due to improper or unreasonable use by the
Lessee shall be repaired and restored by the Lessor at the cost of the Lessee. The Lessor shall provide t he receipt of payment
for such repair and restoration. 6- 3租赁期间,甲方保证该房屋及其附属设施处于正常的可使用和安全的状态。甲方对该房屋进行检查、养护,应
提前三日通知乙方。检查养护时,乙方应予以配合。甲方应减少对乙方使用该房屋的影响。
The Lessor ensures that the Leased Premises and auxiliary facilities thereof are in a normal, serviceable and safe
condition during the Term. The Lessor shall give a three days 'prior notice to the Lessee in the case of any repair or
maintenance thereto, for which the Lessee shall provide cooperation. The Lessor shall minimize the impact of such re pair or
maintenance on the Lessee. 6-4除本合同附件(三)夕卜,乙方另需装修或者增设副属设施和设备的,应事先征得甲方的书面同意,按规定须向
有关部门批准审批的,则还应由甲方报请有关部门批准后,方可进行。乙方增设的附属设施和设备及其维修责任由甲、 乙双方另行书面约定。
Subject to Annex 3 hereto, any improvements or additions to the Leased Premises by the Lessee shall be subject to prior
written consent of the Lessor and, if applicable, be reported by the Lessor to relevant authorities for approva l before they are
made. The auxiliary facilities and equipments added by the Lessee and the responsibilities for repair thereof shall be separately
negotiated and agreed upon in writing between the Parties. 七、房屋返还时的状态
Condition of Leased Premises upon Return 7- 1除甲方同意乙方续租外,乙方应在本合同的租期届满后的当日内应返还该房屋,未经甲方书面同意逾期返还房 屋的,每逾期一日,乙方应按日租金的双倍价格向甲方支付该房屋占用使用费。
Unless the Lessor agrees on extension of the lease, the Lessee shall return the Leased Premises to the Lessor on the
date when this Contract expires. If the Leased Premises are returned after that date without consent of the Lessor, the
Lessee shall pay the Lessor a penalty double the daily rental for each day of delay.
7- 2乙方返还该房屋应当符合正常使用后的状态。返还时,应经甲方验收认可,并相互结清各自应当承担的费用。
The Leased Premises shall be in such a condition as after normal use upon return. The Leased Premises shall be
examined by the Lessor upon return and, if accepted, the costs and expensespayable by each Party shall be settled. 八、转租、转让和交换
Sublet, Transfer and Exchange 8- 1除甲方已在本合同补充条款中同意乙方转租外,乙方在租赁期内,需事先征得甲方的书面同,方可将该房屋部
分或全部转租给他人。但同一间居住房屋,不得分割转租。
Unless the Lessor agrees on subletting by the Lessee in the Supplementary Clauses, the Lessee shall not sublet o r
assign the Leased Premises in part or in whole to any third party without prior written consent of the Lessor within the Term.
Any room of the Leased Premises shall not be divided into sub-parts during subletting.或农场系统受理处办理登记备案。
The Lessee shall, when subletting the Leased Premises, enter into a subletting contract as required with the party accepting
subletting and file with the District or County Real Estate Trade Center or the farm system filing office at the place of the Leased
Premises. 8- 3在租赁期内,乙方将该房屋转让给他人承租或与他人承租的房屋进行交换,必须事先征得甲方书面同意。转让
或交换后,该房屋承租权的受让人或交换人应于甲方签订租赁主体变更合同并继续履行本合同。
The Lessee shall not transfer the Leased Premises to other lessees or exchange the Leased Premises with any oth er
person during the Term without prior written consent of the Lessor. After such transfer or exchange, the transferee or exchanging

8-2乙方转租该房屋,应按规定与接受转租方订立书面的转租合同。并按规定向该房屋所在区、县房地产交易中心
party shall enter into a contract on change of the Lessee hereto with the Lessor and continue to perfor m this Contract. 8-4租赁合同期间,甲方若出售该房屋,甲方将保证在该房屋出售后本租赁合同的正常履行。乙方放弃对该房屋 的优先购买权。
If the Lessor sells the Leased Premises during the Term of this Contract, the performance of this Contract shall not be
affected. In the event of a sale to a 3rd Party, the Lessee shall waive the right of first refusal to purchase the Leased Premises. 九、解除本合同的条件
Termination of the Contract 9- 1甲、乙双方同意在租赁期内,有下列情况之一的,本合同终止,双方互不承担责任:

The Parties agree that this Contract may be terminated during the Term in any of the following circumstances an d the Parties shall not assume any liability onto each other: (1 该房屋占用范围内的土地使用权依法提前收回的;
The right to use the land within the occupancy of the Leased Premises are taken back according to law; (2 该房屋因社会公共利益被依法征用的;
The Leased Premises are confiscated for public interests acceding to law; (3 该房屋毁损、灭或者被鉴定为危险房屋的;
The Leased Premises are damaged, lost or declare d dilapidated; (4 该房屋因城市建设需要被依法列入房屋拆迁许可范围的;
The Leased Premises are legally included into the scope of demolition to accommodate the needs of urban constr uction;
or 9- 2甲、乙双方同意,有下列情形之一的,一方可书面通知另一方解除本合同。违反合同的一方,应向另一方按月
租金的双倍支付违约金;给对方造成损失的,支付的违约金不足抵付一方损失的,还应赔偿造成的损失与违约金的差额 部分:
The Parties agree that the non-breaching Party may terminate this Contract by a written notice in any of the foll owing
cases, and the breaching Party shall pay the non-breaching Party a penalty double the monthly rental. Where an y loss
incurred to the non-breaching Party is not fully covered by the penalty paid, the breaching Party shall pay the difference
between the loss and the penalty. (一)甲方未按时交付该房屋,经乙方催告后十五日内仍未交付的; The Lessor fails to deliver the Leased Premises within the specified time limit and still fails to do so within fift een days upon notification by the Lessee; (二) 甲方交付的该房屋不符合本合同的约定,致使不能实现租赁目的;或甲方交付的房屋存在缺陷,致使乙方不
能居住、生活

The Leased Premises delivered by the Lessor do not comply with this Contract and render it impossible to meet the
purpose of lease, or have defects that may make the Leased Premises uninhabitable; (三) 乙方未征得甲方书面同意改变房屋用途的
The Lessee changes the purpose of the Leased Premises without written consent of the Lessor and causes damage to
the structure thereof; (四) 因乙方原因造成房屋主体结构损坏的;
The main structure of the Leased Premises is damaged due to causes attributable to the Lessee; 乙方未经得甲方书面同意擅自转租该房屋、转让该房屋承租权或与他人交换各自承租的房屋的;
The Lessee sublets or transfers or exchanges with others the Leased Premises without written approval of the Les sor; or (六)乙方逾期不支付租金累计超过三十日的;

十、违约责任
Liabilities for Breach of Contract 10- 1该房屋交付时存在缺陷的,造成乙方无法居住、生活的,甲方应自交付之日起的五日内进行修复,逾期不修
复的,甲方同意减少租金并变更有关租金条款。
Where the Leased Premises are found to have any defects that make the Leased Premises uninhabitable upon deli very,
the Lessor shall repair such defects within five (5 days upon delivery. If the Lessor fails to do so within the s pecified time limit,

the Lessor agrees to reduce the rental and alter relevant rental provisions. 10- 2因甲方未在本合同中告知乙方,该房屋出租前已抵押或产权转移已受到限制,造成乙方损失的,甲方应负责 赔偿。
Where the Lessee suffers from any loss due to failure of the Lessor to disclose in this Contract the fact that the Leased
Premises have been mortgaged or transferred in ownership or restrained, the Lessor shall compensate the Less ee for such
loss. 10-3租赁期间,甲方不及时履行本合同约定的维修、养护责任,致使房屋损坏,造成乙方财产损失或人身伤害的, 甲方承担赔偿责任。
10-4租赁期间,非本合同规定的情况甲方擅自解除本合同,提前收回该房屋的,甲方应按提前收回天数的租金的 _
_____ 倍向乙方支付违约金。若支付的违约金不足抵付乙方损失的,甲方还应负责赔偿。
10-5乙方未征得甲方书面同意或者超出甲方书面同意的范围和要求装修房屋或者增设附属设施的,甲方可以要求 乙方赔偿损失。
Where the Lessee makes any improvements and/or additions to the Leased Premises without or beyond the scope of the
written consent of the Lessor, the Lessor may require the Lessee to compensate the Lessor for its loss incurre d therefrom. 十、其他条款
Miscellaneous 11- 1租赁期间,甲方需抵押该房屋,应当书面通知乙方。
The Lessor shall notify its intention (if any of mortgaging the Leased Premises during the Term. 11- 2本合同自双方签字生效。
This Contract shall become effective upon signatures affixed by the Parties. 11-3本合同未尽事宜,经甲、乙双方协商一致,可订立补充条款。本合同补充条款及附件均为本合同不可分割的一
部分,本合同及其补充条款和附件内空格部分填写的文字与铅印文字具有同等效力。


Anything not covered hereunder shall be made into Supplementary Causes hereto through amicable negotiation bet
ween the Parties. The Supplementary Clauses and annexes hereto shall be an integral part of this Contract. The handwritten
words in the blank space of this Contract and the Supplementary Clauses and annexes hereto shall bear the sa me legal force
as the printed words. 11-4甲、乙双方在签署本合同时,对各自的权利、义务、责任清楚明白,并愿按合同规定严格执行。如一方违反本
合同,另一方有权按本合同规定索赔。
The Parties fully understand their respective rights, obligations and responsibilities when exec uting this Contr act and are willing to fully observe this Contract. If a Party breaches this Contract, the other Party may claim against the breaching Party. 11-5甲、乙双方就履行本合同发生纠纷,应通过协商解决;协商解决不成的可选择下列一种方式解决(下列两种方
式由甲、乙双方共同任选一种):
Any dispute arising from or in connection with this Contract shall be settled through amicable negotiation betwee n the Parties or, if such negotiation fails, settled by ( of the following ways (the Parties jointly select one of the two options provided below: ( 提交中国对外经济贸易委员会上海仲裁委员会仲裁;
Submit the dispute to the Shanghai Branch of China Internal Foreign Economic and Trade Arbitration Commissio n for
arbitration; ( 依法向人民法院起诉。
To file a lawsuit in a court having jurisdiction over the Property. 11-6本合同连同附件一式三份。其中:甲、乙双方各执一份,以及
xxx—份,均具有同等效力。
This Contract and its annexes are made in three original copies, one for each of the Parties and one for Phoenix Property
Agency.

补充条款
Supplementary Clauses 1、关于租金:xxxxa〈每月的租金为人民币XX沅,包括物业管理费,开具租赁发票,家庭会所卡,安装卫星以
及开通电话、宽带等全部费用。乙方应在租赁合同签定后 7个工作日内支付首月租金以及两个月保证金。甲方在收到租 金以及保证金后3个工作日内提供给乙方一张押金收据以及正规房屋租赁发票一张。以后的每月租金也应在每个月的1
号前以银行转账方式支付给甲方。
Rental: The monthly rental from >oo
inclusive of property management fee, tax invoi ce,
family club house card, cable TV, internet and telephone installation fee. The Lessee shall pay the Lessor the rent al for the
first month together with the security deposit within seven working days upon receving the payment notice from Party A after the exec ution of this Contract. The monthly rental thereafter shall be paid to the Lessor befor e the 1 th day of each month through bank transfer, and the Lessor shall issue a formal house lease invoice to the L essee 15 days in advance as a payment notice. 如租金到期后5天仍未支付乙方须按日加付租金0.3%的滞纳金如超过15天未付则视为乙方自动退租构成违约
甲方在给乙方发出一份书面通知的前提下有权收回出租物业
并追究乙方违约责任.甲方有权自动扣除全额押金.
If the rental shall be un-paid for five days after the same shall become due and payable, the Lessee shall be liab le to pay
a late penalty fee equals to 0.3% of the rent per day. If the rental has not been paid more than 15 days af ter the due ate, Lessee
will be deemed to have automatically terminated the tenancy resulting in a breach of this Agre ement. The Lessor will then be
entitled, after sending a written notice, to take back the leased property and have reco urse against the Lessee for breach of the
contract. The Lessor will automatically forfeit the deposit.

Payment and return of security deposit: The security deposit for the Leased Premises shall be equal to the rental for two months RMX XX, which amount shall be paid through bank transfer within five working days upon exe c ution of this Contract. The Lessor shall provide a receipt of security deposit after receiving the same equal to the t wo-month rental. 租赁期满后,在乙方交还正常使用后的房屋及其房内设备并结清所有费用后,甲方在 5个工作日内向乙方无息退还
押金。乙方如未按本合同规定付清所有费用或对房屋结构和房内设备造成损坏的(自然损耗除外),乙方应负责赔偿。
甲方有权从押金中扣除相应部分。如押金不足以赔偿损失的,乙方应补足差额。
The Lessor shall return the deposit to the Lessee at the expiry date of the tenancy agreement providing that the Lessee returns the premises and all fixtures and fittings in good condition fair wear and tear excepted, and subject to the Lessee having paid all charges and utilities and telephone charges required to be paid under the terms of this agr eement. The

Lessor has the right to withhold all of the deposit until such time as all these charges have been paid in full. The deposit shall be returned by the Lessor within 5 working days of receipt of proof of payment. In the eve nt that the Lessee, at the expiration of the agreement returns the premises to the Lessor in a condition different to the condition at handover, normal fair wear and tear excepted, the Lessor has the right to make deductions to or withhol d payment of all or part of the deposit to the Lessee. 3 在租赁合同期内,在第一年租期中XXXXXX如乙方提前终止合同应提前一个月书面通知甲方并支付给甲

Provide a cover for the out-door car park space 交房前彻底清洁房屋,测试中央空调,地暖,卫星以及网络,保证正常使用
Test run central air-con , floor heating, Satellite TV, internet and well clean the house. 入住前提供部分家具:一个双人床(主卧室),一个单人床带抽屉(客卧), L型沙发(地下室),厨房脚凳 宜家风格Provide 1 king size bed, 1 kid ' bed , 1 L sharp sofa , 5 seat in the kitchen Ikea Style

Provide two lights above the gas cooker 更换客厅以及每个房间的窗帘,卧室提供遮光帘(米色)
Change the curtains in each living room and bedroom for cream color. Provide blinder for each bedroom 二楼3个卧室各提供一个衣柜
Provide three closet for each bedroom in 2nd floor 5、甲方应提供家具清单上的所有电器,当乙方入住时,甲乙双方都要在家具清单上签字。
The Lessor shall provide all electrical appliances indicated in the list of furniture, and the Parties shall sign st of furniture upon move-in of the Lessee.

6、甲方在乙方入住时交付给乙方所有的房门钥匙。
The Lessor shall hand over keys of all doors of the Leased Premises to the Lessee upon move-in thereof. 7 甲方在乙方入住前彻底清扫房屋和房内的设备。
The Lessor shall thoroughly clean the Leased Premises and equipments therein before move-in of the Lessee. 8 甲方在乙方入住前检查所有的设备,电器并做必要的维护工作以便乙方在入住后能正常使用。
The Lessor shall check all equipments and electrical appliances before move-in of the Lessee, and carry out nece ssary
maintenance to ensure normal use after move-in of the Lessee. 9 甲方的房屋房地产权证和身份证复印件,乙方的营业执照复印件作为附件。
The copies of the certificate of Title Deed to house and ID card of the Lessor, and the copy of the business lic ense of the
Lessee, shall be attached as annexes to this Contract. 10 乙方在租赁期间应及时按账单来支付实际使用的水
电,煤气,宽带和电话的费用,并保存所有的账单。如因
乙方没有按时支付应付费用产生的后果,由乙方自行负责。
The Lessee shall pay the bills for water, electricity, gas, broadband and telephone in due time during the Term a nd to
keep all such bills properly. If the Lessee fails to make timely payment of the above listed bills, the Lessee wi ll bear full
responsibility for failure to make payment. 11 乙方不得在该物业内,收藏政府违禁之物品,军械、火药、硫磺、汽油,及挥发性之化工原料,或有爆炸之危
险物品,均不得陈放该物业内外任何地方,否则,一切后果由乙方负责。对甲方物业造成的损失
乙方应负责赔偿。
Not to store arms, ammunition or unlawful goods, gun-powder, kerosene or any explosive or combustible substanc e at the said Property, and to be responsible for any consequenceof any breach of local Ordinances or Chinese laws,
any damage caused to the house, The Lessee should be responsible for it. 12、在租赁期内如因物业损坏,在甲方给乙方最短三个工作日通知的前提下,可以查看该物业


The Lessee will permit the Lessor to periodically inspect the property for damages. The Lessor will provide the
Lessee with a minimum of 3 business days notice. 13、乙方未征得甲方书面同意的情况下,不得在该房屋内饲养宠物。
The lessee will not keep pets in the Leased premises without the written permission of the Lessor. 14、若补充条款与合同正文不一致,以补充条款为准。
In the case of any discrepancy between the Supplementary Clauses and the main body of the Contract, the Suppl ementary Clauses shall prevail. 15、英文合同仅供参考。
