MICROSOFTPRE-RELEASESOFTWARELICENSETERMSMICROSOFTWORLDWIDETELESCOPE
TheselicensetermsareanagreementbetweenMicrosoftCorporation(orbasedonwhereyoulive,oneofitsaffiliatesandyou.Pleasereadthem.Theyapplytothepre-releasesoftwarenamedabove,whichincludesthemediaonwhichyoureceivedit,ifany.ThetermsalsoapplytoanyMicrosoft

updates,supplements,
Internet-basedservices,andsupportservices
forthissoftware,unlessothertermsaccompanythoseitems.Ifso,thosetermsapplytothoseitems.Byusingthesoftware,youaccepttheseterms.Ifyoudonotacceptthem,donotusethesoftware.
Asdescribedbelow,usingsomefeaturesalsooperatesasyourconsenttothetransmissionofcertainstandardcomputerinformationforInternet-basedservices.Ifyoucomplywiththeselicenseterms,youhavetherightsbelow.
1.INSTALLATIONANDUSERIGHTS.

Youmayinstallandtestanynumberofcopiesofthesoftwareonyourpremises.
Youmaycreatetourssolely(aforpersonaland/ornon-commercialuseor(bforsubmissiontoMicrosoftforconsiderationofinclusioninWorldWideTelescope,subjecttoaTourSubmissionAgreement.
2.INTERNET-BASEDSERVICES.MicrosoftprovidesInternet-basedserviceswiththesoftware.Itmay
changeorcancelthematanytime.
a.ConsentforInternet-BasedServices.Thesoftwarefeaturedescribedbelowconnectsto
MicrosoftorserviceprovidercomputersystemsovertheInternet.Insomecases,youwillnotreceiveaseparatenoticewhentheyconnect.Byusingthisfeature,youconsenttothetransmissionofthisinformation.Microsoftdoesnotusetheinformationtoidentifyorcontactyou.
i.ComputerInformation.ThefollowingfeatureusesInternetprotocols,whichsendtothe
appropriatesystemscomputerinformation,suchasyourInternetprotocoladdress,thetypeofoperatingsystem,browserandnameandversionofthesoftwareyouareusing,andthelanguagecodeofthedevicewhereyouinstalledthesoftware.MicrosoftusesthisinformationtomaketheInternet-basedserviceavailabletoyou.

WebContentFeatures.FeaturesinthesoftwarecanretrieverelatedcontentfromMicrosoftandprovideittoyou.Toprovidethecontent,thesefeaturessendtoMicrosoftthetypeofoperatingsystem,nameandversionofthesoftwareyouareusing,typeofbrowserandlanguagecodeofthedevicewhereyouinstalledthesoftware.Examplesofthesefeaturesaretourauthoringassistance,toursearchwebpage,andwebhelp.Youmaychoosenottousethesewebcontentfeatures.
ii.UseofInformation.Wemayusethecomputerinformation,toimproveoursoftwareand
services.Wemayalsoshareitwithothers,suchashardwareandsoftwarevendors.TheymayusetheinformationtoimprovehowtheirproductsrunwithMicrosoftsoftware.b.MisuseofInternet-basedServices.Youmaynotusethisserviceinanywaythatcouldharmitor
impairanyoneelse’suseofit.Youmaynotusetheservicetotrytogainunauthorizedaccesstoanyservice,data,accountornetworkbyanymeans.

3.TERM.Thetermofthisagreementis5years,orcommercialreleaseofthesoftware,whicheverisfirst.4.PRE-RELEASESOFTWARE.Thissoftwareisapre-releaseversion.Itmaynotworkthewayafinal
versionofthesoftwarewill.Wemaychangeitforthefinal,commercialversion.Wealsomaynotreleaseacommercialversion.5.FEEDBACK.IfyougivefeedbackaboutthesoftwaretoMicrosoft,yougivetoMicrosoft,withoutcharge,
therighttouse,shareandcommercializeyourfeedbackinanywayandforanypurpose.Youalsogivetothirdparties,withoutcharge,anyintellectualpropertyrightsneededfortheirproducts,technologiesandservicestouseorinterfacewithanyspecificpartsofaMicrosoftsoftwareorservicethatincludesthefeedback.YouwillnotgivefeedbackthatissubjecttoalicensethatrequiresMicrosofttolicenseitssoftwareordocumentationtothirdpartiesbecauseweincludeyourfeedbackinthem.Theserightssurvivethisagreement.6.SCOPEOFLICENSE.Thesoftwareislicensed,notsold.Thisagreementonlygivesyousomerightsto
usethesoftware.Microsoftreservesallotherrights.Unlessapplicablelawgivesyoumorerightsdespitethislimitation,youmayusethesoftwareonlyasexpresslypermittedinthisagreement.Indoingso,youmustcomplywithanytechnicallimitationsinthesoftwarethatonlyallowyoutouseitincertainways.Youmaynot

disclosetheresultsofanybenchmarktestsofthesoftwaretoanythirdpartywithoutMicrosoft’spriorwrittenapproval;
workaroundanytechnicallimitationsinthesoftware;
reverseengineer,decompileordisassemblethesoftware,exceptandonlytotheextentthatapplicablelawexpresslypermits,despitethislimitation;publishthesoftwareforotherstocopy;rent,leaseorlendthesoftware;
transferthesoftwareorthisagreementtoanythirdparty;orusethesoftwareforcommercialsoftwarehostingservices.
7.WINDOWSLIVEID,PASSWORD,ANDSECURITY.YouarerequiredtouseWindowsLiveIDto
accesstheServices.YouareentirelyresponsibleformaintainingtheconfidentialityofyourpasswordandWindowsLiveID.Furthermore,youareentirelyresponsibleforanyandallactivitiesthatoccurunderyourWindowsLiveID.YouagreetonotifyMicrosoftimmediatelyofanyunauthorizeduseofyourWindowsLiveIDoranyotherbreachofsecurity.MicrosoftwillnotbeliableforanylossthatyoumayincurasaresultofsomeoneelseusingyourpasswordorWindowsLiveID,eitherwithorwithoutyourknowledge.However,youcouldbeheldliableforlossesincurredbyMicrosoftoranotherpartyduetosomeoneelseusingyourWindowsLiveIDorpassword.Youmaynotuseanyoneelse'sWindowsLiveIDatanytime,withoutthepermissionoftheWindowsLiveIDholder.
8.EXPORTRESTRICTIONS.ThesoftwareissubjecttoUnitedStatesexportlawsandregulations.You
mustcomplywithalldomesticandinternationalexportlawsandregulationsthatapplytothesoftware.Theselawsincluderestrictionsondestinations,endusersandenduse.Foradditionalinformation,seewww.microsoft.com/exporting.
9.SUPPORTSERVICES.Becausethissoftwareis“asis,”wemaynotprovidesupportservicesforit.10.ENTIREAGREEMENT.Thisagreement,andthetermsforsupplements,updates,Internet-based
servicesandsupportservicesthatyouuse,aretheentireagreementforthesoftwareandsupportservices.11.APPLICABLELAW.
a.UnitedStates.IfyouacquiredthesoftwareintheUnitedStates,Washingtonstatelawgovernsthe
interpretationofthisagreementandappliestoclaimsforbreachofit,regardlessofconflictoflawsprinciples.Thelawsofthestatewhereyoulivegovernallotherclaims,includingclaimsunderstateconsumerprotectionlaws,unfaircompetitionlaws,andintort.

b.OutsidetheUnitedStates.Ifyouacquiredthesoftwareinanyothercountry,thelawsofthat
countryapply.12.LEGALEFFECT.Thisagreementdescribescertainlegalrights.Youmayhaveotherrightsunderthelaws
ofyourcountry.Youmayalsohaverightswithrespecttothepartyfromwhomyouacquiredthesoftware.Thisagreementdoesnotchangeyourrightsunderthelawsofyourcountryifthelawsofyourcountrydonotpermitittodoso.13.DISCLAIMEROFWARRANTY.Thesoftwareislicensed“as-is.”Youbeartheriskofusingit.
Microsoftgivesnoexpresswarranties,guaranteesorconditions.Youmayhaveadditionalconsumerrightsunderyourlocallawswhichthisagreementcannotchange.Totheextent
permittedunderyourlocallaws,Microsoftexcludestheimpliedwarrantiesofmerchantability,fitnessforaparticularpurposeandnon-infringement.14.LIMITATIONONANDEXCLUSIONOFREMEDIESANDDAMAGES.Youcanrecoverfrom
MicrosoftanditssuppliersonlydirectdamagesuptoU.S.$5.00.Youcannotrecoveranyotherdamages,includingconsequential,lostprofits,special,indirectorincidentaldamages.
Thislimitationappliesto
anythingrelatedtothesoftware,services,content(includingcodeonthirdpartyInternetsites,orthirdpartyprograms;and
claimsforbreachofcontract,breachofwarranty,guaranteeorcondition,strictliability,negligence,orothertorttotheextentpermittedbyapplicablelaw.
ItalsoappliesevenifMicrosoftkneworshouldhaveknownaboutthepossibilityofthedamages.Theabovelimitationorexclusionmaynotapplytoyoubecauseyourcountrymaynotallowtheexclusionorlimitationofincidental,consequentialorotherdamages.
