HavingregardtotheTreatyestablishingtheEuropeanEconomicCommunity,andinparticularArticle100athereof,
HavingregardtotheproposalfromtheCommission(1,
IncooperationwiththeEuropeanParliament(2,
HavingregardtotheopinionoftheEconomicandSocialCommittee(3,
Whereasitisnecessarytoadoptmeasureswiththeaimofprogressivelyestablishingtheinternalmarketoveraperiodexpiringon31December1992;whereastheinternalmarketcomprisesanareawithoutinternalfrontiersinwhichthefreemovementofgoods,persons,servicesandcapitalisensured;
WhereasMemberStatesareresponsibleforprovidingadequateprotectionforradiocommunicationsandthedevices,apparatusorsystemswhoseperformancemaybedegradedbyelectromagneticdisturbanceproducedbyelectrialandelectronicapparatusagainstthedegradationcausedbysuchdisturbances;
WhereasMemberStatesarealsoresponsibleforensuringthatelectricenergydistributionnetworksareprotectedfromelectromagneticdisturbancewithcanaffectthemand,consequently,equipmentfedbythem;
WhereasinsomeMemberStates,mandatoryprovisionsdefineinparticularthepermissibleelectromagneticdisturbancelevelsthatthisequipmentisliabletocauseanditsdegreeofimmunitytosuchsignals;whereasthesemandatoryprovisionsdonotnecessarilyleadtodifferentprotectionlevelsfromoneMemberStatetoanotherbutdo,bytheirdisparity,hindertradewithintheCommunity;
